These terms govern your use of Foodle's restaurant app development platform and services.
1. Acceptance of Terms
By accessing or using Foodle's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.
2. Description of Services
Foodle provides a restaurant app development platform that enables restaurants to create branded mobile applications, process direct orders, manage customer relationships, and integrate with delivery services.
3. User Accounts and Registration
To use our services, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Restaurant Services
Our platform enables restaurants to receive direct orders, manage customer data, process payments, and integrate with third-party delivery services. Commission rates and fees are clearly disclosed during onboarding.
5. Payment Terms
Payment processing fees, commission rates, and payout schedules are outlined in your restaurant agreement. We use secure, PCI-compliant payment processors to handle all transactions.
6. Acceptable Use
You agree to use our services lawfully and not engage in activities that could harm our platform, other users, or violate applicable laws and regulations.
7. Intellectual Property
Foodle owns all intellectual property rights in our platform. You retain rights to your restaurant's branding and content, while granting us license to use them in providing our services.
8. Data and Privacy
We handle personal data in accordance with our Privacy Policy. You maintain ownership of your customer data while granting us necessary permissions to provide our services.
9. Service Availability
We strive to maintain high service availability but cannot guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible.
10. Limitation of Liability
Our liability is limited to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages arising from your use of our services.
11. Termination
Either party may terminate this agreement with appropriate notice. Upon termination, you retain access to your data and we assist with migration to other platforms if needed.
12. Governing Law
These terms are governed by the laws of the United Arab Emirates. Any disputes will be resolved through arbitration in Dubai, UAE, in accordance with Dubai International Arbitration Centre rules.
13. Changes to Terms
We may update these terms from time to time. Significant changes will be communicated with at least 30 days notice. Continued use of our services constitutes acceptance of updated terms.
